The Euroasian economic community

            The Euroasian economic community was created 10 October, 2000 in Astana as the international economic organization according to the Treaty of establishment of the Euroasian economic community (   EEC) signed by the heads of states – participants of the Custom Union.

            The concept of close and effective trade and economic cooperation for achievement of the purposes and tasks, determined by the Treaty of the Custom union and Uniform economic space from February , 26,1999, is incorporated in the Treaty of establishment of the EES. Organizational-legal tools of realization of achievement arrangements and mechanisms of synchronous and adequate fulfillment of the made international treaties, introduction of the monitoring for realization of accepted decisions are stipulated.

            The Treaty of establishment of the EEC provides succession of accepted treaties and decisions within the framework of the Customs union, determining from which are:

The agreement on the Customs union;

The agreement on connection of the Republic of Kazakhstan to the Customs Union from 20.01.95.;

The Treaty of a deepening of integration, in economic and humanitarian spheres from 29.03.96.

The Agreement on uniform measures of not tariff regulation at formation of the Customs union from 22.11.97.

The purposes and tasks

Consummation of registration in full space of free trade formation of the uniform common custom tariff and uniform system of measures of not traffic regulation. Development of the coordinated position of Member-states in mutual relation from WTO and other international economic organization . Ensuring of economic safety on external borders of the Community struggle against smuggling and other kinds of customs offences. Realization of the coordinated structural reorganization of economy development and realization of joint programs, social and economic development.

            Formation of the common market of transport services and uniform transport system.

            Formation of the common power market.

            Harmonization of national education system, development of the science and culture.

            Representation of the equal rights to the citizens of Member-states in reception, of education and medical aid on all its territory synchronization of terms of performance of interstates producers of  the treaties made in framework of the EEC.

            Ensuring of interaction of legal system of states-participants in the purposes of creation of the common legal space with the framework of Community.

Intergovernmental Council – the supreme body of management, is submitted by the heads of the states and heads of governments of considers the principal questions of Community, connected to the general interests of Member-States, defines strategy, directions and perspectives of integrational development and makes the decisions directed on realization of the purposes and tasks of the EEC.

            Integrational Committee is constant working body, providing interaction of bodies of the EEC and the control over realization of the decision, accepted by Inter-governmental Council.

            The Inter-parliamentary Assembly   is the body of inter-parliamentary cooperation considering the questions of harmonization of the national legislation of Member-States of the EEC.

            The Court of Community provides uniform application of Treaties, working within the framework of community and decisions, accepted by EEC’s bodies. Now, decisions of assign the functions of EEC’s court  to Economic Court of the CIS is accepted.

            The branch commissions, councils and subsidiary organs of the EEC operate on various spheres.

Except the authorised  bodies determined by the Treaty of establishment of the EEC, within the framework of Community.

Contractual-legal base

            In total for the period since 1996 on present time, 79 international trearies are signed within the framework of the Customs Union and EEC.

            Activity

The Euroasian Economic community – one of the most developed regional associations on space of the CIS. Participation in work of the regional association is one of the priorities of foreign policy of Kazakhstan . In December 2003, EEC has received the status of the observers at the General assembly of the UN, that means a recognition of the integration association  by the world community.

            It should note that interaction of Member-States of the EEC has reached such stage, when the common custom tarrifs are entered on the majority of the nomenclature of the goods, the coordinated measures of not tariff regulation are, carried out, in relation to the third  countries the common trading modes are formed Creation, of uniform customs territory is started a number of concrete joint steps is undertaken in the humanitarian sphere allowing to satisfy the reguirement of citizens of our countries in the fields of education, culture, public health services and maintenance of the social rights more full.

            From the moment of signing of the Treaty of establishment of the EEC to signification volume of international legal work on concrete filling norms and positions of the Treaty of establishment of the EEC to creation of controls of Community and development of the document, regulating their activity fastening of the legal status, privileges and immunities of officials of the new international organization creating of necessary conditions for effective realization of the duties is done them.

            During Intergovernmental Council (At a level of the Heads of the States) in Dushanbe on April 27, 2003, the report of Chairman of Intergovernmental Council of the EEC, the President of the Republic of Kazakhstan N.A.Nazarbaev about a state of affairs in Euroasian economic community and offers on acceleration of integration cooperation which determines the basic purposes and tasks of Community.

On the basis of the given report the Parties had been developed «Рpriority directions of cooperation in frameworks of ECC on 2003-2006 and the next years” and Actions on realization of Priority directions of development of the EEC on 2003-2006 and the next years authorized by the Decision of the heads of Member-states from February 9, 2003, # 152.

            Thus Member-States of EEC have determined the further sterp-by-step actions with the purpose of the subsequent deepening of integration processes within the framework of Community.

            Besides Member-States of Community recognizing importance of development of interaction of member-states in real sector of economy, have made the decision on activization of work on attraction of business circles to interaction processes in framework of the EEC.

            In these purposes, Association Business Council EEC was created in summer 2000.

In February, 2003, in Moscow has the first Economic forum of EEC has passed in Moscow on which the constructive exchange of opinions has taken place on various directions of cooperation and offers under the project representing mutual interest are brought. The international Congress EEC – the Business World has taken place in September 2004.

On june,22, 2005, 13 session Inter-governmental Council of EEC has taken place in Moscow (at a level of the heads of the state). In the course of which the Presidents have discussed the further step on a deepening of integration interaction and distances the concrete assignment was given to the governments of the parties on activization of cooperation in Economy.

On September, 27, 2003 at session of Inter-governmental Council of EEC (at a level of the heads o government) a number of documents of the commities’s countries, regulating activity in fuel and energy, transport areas etc, has been accepted. Besides necessity of acceleration of process of creation of Common Custom traffic of EEC is marked.

In October, 6, 2005, at summit of the head of the states of the Organization (The Central-Asian Cooperation ) the decision on association of this organization with Euroasian economic community is accepted. Thus, one more state-participant has appeared on behalf of Uzbekistan.

On January 25, 2006 at extraordinary summit of the heads of member-states of the EEC with participation of the President of Republic Uzbekistan, I.Karimov, the Report on connection of Republic Uzbekistan to the Treaty on establishment of the Euroasian economic community from October, 10, 2000 has been signed, the full membership of Uzbekistan in Community thus is made out.
